THE NEATH TO ABERGAVENNY TRUNK ROAD (A465)

 

(ABERGAVENNY TO HIRWAUN DUALLING AND SLIP ROADS) AND EAST OF ABERCYNON TO EAST OF DOWLAIS TRUNK ROAD (A4060) AND CARDIFF TO GLAN CONWY TRUNK ROAD (A470) (CONNECTING ROADS) (DOWLAIS TOP TO HIRWAUN) (SIDE ROADS) ORDER 2019 (VARIATION) (NO. 2) ORDER 2021

 

NOTICE IS HEREBY GIVEN that the Welsh Ministers have made an Order under sections 14, 125, 268 and 326 of the Highways Act 1980 to vary The Neath to Abergavenny Trunk Road (A465) (Abergavenny to Hirwaun Dualling and Slip Roads) and East of Abercynon to East of Dowlais Trunk Road (A4060) and Cardiff to Glan Conwy Trunk Road (A470) (Connecting Roads) (Dowlais Top to Hirwaun) (Side Roads) Order 2019, as varied by The Neath to Abergavenny Trunk Road (A465) (Abergavenny to Hirwaun Dualling and Slip Roads) and East of Abercynon to East of Dowlais Trunk Road (A4060) and Cardiff to Glan Conwy Trunk Road (A470) (Connecting Roads) (Dowlais Top to Hirwaun) (Side Roads) Order 2019 ( Variation) Order 2020.

 

THE VARIATION (NO.2) ORDER 2021 will authorise the Welsh Ministers to—

(a) carry out the improvement of highways;

(b) stop up highways or areas of highway;

(c) construct new highways;

(d) stop up private means of access to premises;

(e) provide new means of access to premises;

(f) close highways temporarily;

(g) provide temporary highways, and

(h) provide for the transfer of the new highways to Merthyr Tydfil County Borough Council, Rhondda Cynon Taf County Borough Council and Caerphilly County Borough Council as from the date the Welsh Ministers notify those Councils that they have been completed and are open for through traffic.

 

THE VARIATION (NO.2) ORDER 2021 will substitute the Site Plans numbered 2A, 3A, 4A, 5, 6A, 9 and 10A to the plan portfolio HA14/1 WG17 to the Order with the revised site plans numbered 2B, 3B, 4B, 5A, 6B, 9A and 10B in the plan portfolio numbered HA14/1 WG25 to the Variation Order and make minor amendments to the articles and schedules of the Order.

The purpose of the Variation (No.2) Order 2021 is to provide authorisation—

(i) to remove the single gyratory layout at Hirwaun Junction and to replace it with a two linkedroundabout layout, along with minor changes to stopping up arrangements and position and alignment of new highways, footpaths and cycletracks;

(ii) to relocate Pentwyn Cynon Footbridge to the East of its location in the Order, along with associated minor changes to the alignment of both approach access ramps to the north and south;

(iii) to remove the footbridge carrying the Swansea Road footway across the Vale of Neath Railway by making a minor modification to its alignment so that the footpath crossing is made part of the Vale of Neath Railway Underbridge structure;

(iv) to relocate Nant Moel Underpass to the west of its location in the Order, along with associated changes to the alignment of the private means of access approach road from both the north and south;

(v) to make a minor change to the alignment of Swansea Road between its junction with the southern roundabout of Baverstock Junction and the Swansea Road / Merthyr Road roundabout to the East;

(vi) to relocate Taff Trail Footbridge to the east of its location in the Order, along with associated minor changes to the alignment of both approach accesses to the north and south;

(vii) to remove the proposal to stop up parts of the existing footpath under Taf Fechan Viaduct; instead providing a new footpath via the above proposed Taff Trail Footbridge;

(viii) to remove the footbridge across Taf Fechan by making a minor modification to the footpath alignment to the north so that the crossing is made part of the Taf Fechan Viaduct structure;

(ix) to relocate Bryniau Road Overbridge to the west of its location in the Order, along with a minor modification of the approach alignment to the north and south of the structure.

 

COPIES of the Variation (No.2) Order 2021 and its relevant plans, together with the The Neath to Abergavenny Trunk Road (A465) (Abergavenny to Hirwaun Dualling and Slip Roads) and East of Abercynon to East of Dowlais Trunk Road (A4060) and Cardiff to Glan Conwy Trunk Road (A470) (Connecting Roads) (Dowlais Top to Hirwaun) (Side Roads) Order 2019, as varied by The Neath to Abergavenny Trunk Road (A465) (Abergavenny to Hirwaun Dualling and Slip Roads) and East of Abercynon to East of Dowlais Trunk Road (A4060) and Cardiff to Glan Conwy Trunk Road (A470) (Connecting Roads) (Dowlais Top to Hirwaun) (Side Roads) Order 2019 (Variation) Order 2020, and the plans referred to in them, may be inspected free of charge at reasonable hours from 18 February 2021 to 1 April 2021 at the following deposit location, however please see advice at paragraph below:

If any person aggrieved by this Order desires to question its validity, or of any of the provisions contained in it, on the ground that:

a. it is not within the powers of the Highways Act 1980; or

b. that any requirement of the Act or of regulations made under it has not been complied with, that person may, within 6 weeks of them becoming operative make an application for the purpose to the High Court.
