COMPULSORY PURCHASE OF LAND AND NEW RIGHTS BETWEEN DOWLAIS TOP AND HIRWAUN

HE WELSH MINISTERS (THE NEATH TO ABERGAVENNY TRUNK ROAD (A465) (ABERGAVENNY TO HIRWAUN DUALLING AND SLIP ROADS) AND EAST OF ABERCYNON TO EAST OF DOWLAIS TRUNK ROAD (A4060) AND CARDIFF TO GLAN CONWY TRUNK ROAD (A470) (CONNECTING ROADS) (DOWLAIS TOP TO HIRWAUN)) (SUPPLEMENTARY) (NO. 2) COMPULSORY PURCHASE) ORDER 20–

COMPULSORY PURCHASE OF LAND AND NEW RIGHTS BETWEEN DOWLAIS TOP AND HIRWAUN

 

The Welsh Ministers have prepared in draft “The Welsh Ministers (The Neath to Abergavenny Trunk Road (A465) (Abergavenny to Hirwaun Dualling and Slip Roads) and East of Abercynon to East of Dowlais Trunk Road (A4060) and Cardiff to Glan Conwy Trunk Road (A470) (Connecting Roads) (Dowlais Top to Hirwaun)) (Supplementary) (No. 2) Compulsory Purchase) Order 20–”, under sections 239, 240, 250 and 260 of the Highways Act 1980 and under section 2 of, and paragraph 1(1)(b), (3) and (4) of Part 1 of Schedule 2 to, the Acquisition of Land Act 1981. The Welsh Ministers are about to make this Suppementary (No. 2) Compulsory Purchase Order and if made the Order, together with the Compulsory Purchase Order that was made on 17 April 2019 and the Supplementary (No. 1) Compulsory Purchase Order that was made on 26 June 2020, will authorise the Welsh Ministers to purchase compulsorily the land and new rights described below for the purposes of—

 

(a) the construction of the new trunk road, slip roads and connecting roads between Dowlais Top and Hirwaun in the Communities of Rhigos , Pen-y-Waun and Aberdare West and Llwydcoed in the County Borough of Rhondda Cynon Taf and the Communities of Vaynor and Cyfartha in the County Borough of Merthyr Tydfil, in pursuance of “The Neath to Abergavenny Trunk Road (A465) (Abergavenny to Hirwaun Dualling and Slip Roads) and East of Abercynon to East of Dowlais Trunk Road (A4060) and Cardiff to Glan Conwy Trunk Road (A470) (Connecting Roads) Order 1999” as amended by “The Neath to Abergavenny Trunk Road (A465) (Abergavenny to Hirwaun Dualling and Slip Roads) and East of Abercynon to East of Dowlais Trunk Road (A4060) and Cardiff to Glan Conwy Trunk Road (A470) (Connecting Roads) Order 1999, (Dowlais Top to Hirwaun) (Amendment) Order 2019 ” and in pursuance of “The Neath to Abergavenny Trunk Road (A465) (Abergavenny to Hirwaun Dualling and Slip Roads) and East of Abercynon to East of Dowlais Trunk Road (A4060) and Cardiff to Glan Conwy Trunk Road (A470) (Connecting Roads) Order 1999, (Dowlais Top to Hirwaun) (Amendment) Order 20–”;

(b) the construction and improvement of highways and the provision of new means of access to premises, in the said Communities, in the said Counties, in pursuance of “The Neath to Abergavenny Trunk Road (A465) (Abergavenny to Hirwaun Dualling and Slip Roads) and East of Abercynon to East of Dowlais Trunk Road (A4060) and Cardiff to Glan Conwy Trunk Road

(A470) (Connecting Roads), (Dowlais Top to Hirwaun) (Side Roads) Order 2019” as varied by “The Neath to Abergavenny Trunk Road (A465) (Abergavenny to Hirwaun Dualling and Slip Roads) and East of Abercynon to East of Dowlais Trunk Road (A4060) and Cardiff to Glan

Conwy Trunk Road (A470) (Connecting Roads), (Dowlais Top to Hirwaun) (Side Roads) Order 2019 (Variation) Order 2020” and in pursuance of “The Neath to Abergavenny Trunk Road (A465) (Abergavenny to Hirwaun Dualling and Slip Roads) and East of Abercynon to East of Dowlais Trunk Road (A4060) and Cardiff to Glan Conwy Trunk Road (A470)

(Connecting Roads), (Dowlais Top to Hirwaun) (Side Roads) Order 2019 (Variation) (No.2)

Order 20–”;

(c) the improvement of the trunk road between the said Towns, in the said Communities, in the said County Boroughs;

(d) the execution of works on watercourses in connection with the construction of the new trunk road and the construction and improvement of other highways and the execution of other works mentioned above; and

(e) use by the Welsh Ministers in connection with such improvement of highways and the execution of other works mentioned above.

 

A copy of the draft Supplementary (No.2) Compulsory Purchase Order now published and accompanying map, together with the Compulsory Purchase Order that was made on 17 April 2019 and its Statement of Reasons and the Supplementary (No. 1) Compulsory Purchase Order that was made on 26 June 2020 and the accompanying maps, may be seen free of charge at all reasonable hours from 23 July 2020 to 3 September 2020 at the following deposit location:

Any objection to the draft Supplementary (No.2) Compulsory Purchase Order must be made in writing to the Orders Branch, Transport, Welsh Government, Cathays Park, Cardiff CF10 3NQ or by email to TransportOrdersBranch@gov.wales before 3 September 2020 and should state the title of the Order, the reference qA1417207, the grounds of objection and the objector’s address and interests in the land. Please note: Should you wish to object, support or make representations, your correspondence will be considered by the project team and we may need to consult with people and organisations outside of the Welsh Government. As part of this process we may pass information to them, including information you have given us and your personal data. We will however, only disclose your personal details where it is necessary to do so to enable us to deal with the issues raised. Where a trunk road scheme becomes the subject of a Public Local Inquiry (PLI), all correspondence is copied to the Inspector of the PLI and is kept in the PLI Library and is publicly available. If you do not wish for certain personal data to be forwarded to third parties, you should state why when submitting your correspondence and the Welsh Ministers will copy the representations to the appropriate third parties with the name and address removed and if there is to be a PLI, the representations will be seen by the Inspector who may give them less weight as a result.

NOTE: The land and rights comprised in each item below are identified on the map referred to in the draft Order by means of the number or numbers against that item below.

 

IN THE COMMUNITY OF PEN-Y-WAUN IN THE COUNTY BOROUGH OF RHONDDA CYNON TAF

 

The right to enter and re-enter with or without vehicles upon part of garden of the property known as Heulwen Bungalow located north east of and adjacent to Hirwaun Road and south east of Trewaun Junction for all purposes connected with the construction and maintenance of a drainage pipe. (Plot 1/1).

 

The right to enter and re-enter with or without vehicles upon part of wooded land located north east of Hirwaun Road and south east of Trewaun Junction for all purposes connected with the construction and maintenance of a drainage pipe. (Plot 1/2).

 

Part of pasture land, wooded area and bank of ditch located south east of Trewaun Junction and south of the A465 Trunk Road. (Plots 1/3, 1/3a).

 

IN THE COMMUNITY OF RHIGOS IN THE COUNTY BOROUGH OF  RHONDDA CYNON TAF

 

Part of woodland and the eastern bed and bank of the watercourse known as Nant Melyn located south east of the property known as Nant-y-Moel Farm and north of the property known as Ty Croesbychan. (Plots 2/1, 2/1a).

 

Part of wooded bank and bed of the water body known as Nant Hir Reservoir located north east of the property known as Nant Melyn Farm and north west of the property known as Nant Cae Farm. (Plots 3/1, 3/1a).

 

IN THE COMMUNITY OF ABERDARE WEST AND LLWYDCOED IN THE COUNTY BOROUGH OF RHONDDA CYNON TAF

 

Part of pasture land located south of the unnamed road serving Llwydcoed Crematorium and east of and adjacent to the private access serving the property known as Ty-Gwyn Farm. (Plot 4/1).

 

IN THE COMMUNITY OF CYFARTHFA IN THE COUNTY BOROUGH OF MERTHYR TYDFIL

 

Part of woodland and the bed and bank of the watercourse known as Nant Ffrwd including overhead services located north of the property known as Coed Meurig Farm and south west of the A470 Junction. (Plot 5/1).

 

IN THE COMMUNITY OF VAYNOR IN THE COUNTY BOROUGH OF MERTHYR TYDFIL

 

Part of pasture land, woodland and the bed and bank of the watercourse known as Nant Ffrwd including overhead services located north east of the property known as Coed Meurig Farm and west of the A470 Junction (Plots 5/2, 5/2a).

 

Part of National Cycle Route NCR8 and Bridleway 113/999, verge and woodland located north east of St John’s Church and south east of the property known as Ty Newydd Bungalow. (Plot 6/1).
