I expect the local council will be removing hundreds of illegal signs from around Rhondda Cynon Taf all advertising small business and collecting £75 from each business for fly-posting advertising their company, there are lots doted on fences walls etc.

Or are they just picking on one individual anyone know?

Kelly Reardon of Wash n Go car wash and valet service has been fined £75 by Rhondda Cynon Taf Council after displaying a home made sign to advertise his business – a fine he says he is determined not to pay.

Any form of fly-posting (that is, displaying an advertisement without consent) is an offence which is immediately open to prosecution, or to the removal or obliteration of any fly-posting material if the district council or London borough council decide to take remedial action against fly-posting in their area. In the case of a placard or poster, if the material identifies the advertiser displaying it, the Council must give two days’ written notice of the intention to remove or obliterate it. This advance notice gives the advertiser the opportunity to contest the Council’s proposed actions, but if the advertiser is not identified a placard or poster may be immediately removed or obliterated.

Then there’s all the other business in RCT that flout planning law garages that sell vehicles on the highway and grass verges but RCT turn a blind eye to that.

Just pick on the little man and the home made sign and let the bigger companies do as they like typical.

Fly Poster Fined!

A car cleaning company who illegally put up a sign to advertise their business has been fined for their actions.

The Council’s dedicated Streetcare Enforcement team are out in force on foot, bikes and in cars across the County Borough ready to catch offenders, as many unlucky offenders are now finding out.

The Enforcement Officers continue a comprehensive crackdown on litter, dog fouling, flyposting, flytipping, graffiti, cigarette butts and waste issues throughout the County Borough. This is to ensure that Rhondda Cynon Taf will be a clean, green and safe community for everyone to live, work and visit.

Mr Ceri Reardon, who owns Wash and Go, Cwm Cynon Business Park, Mountain Ash has been forced to pay £90 following a successful prosecution by Rhondda Cynon Taf Council’s Streetcare Enforcement Team.

A member of the Council’s Streetcare Enforcement Team came across the sign advertising Mr Reardon’s business on the A4059, Mountain Ash and issued him with a warning only to find that Mr Reardon was continuing to publicise his business in this way. The Streetcare Enforcement Team were then forced to issue him with a Fixed Penalty Notice of £75.

Mr Reardon, failed to pay the Fixed Penalty Notice and the case was referred to Aberdare Magistrates Court.

He was found guilty for his actions on October 19th and was fined £75 and ordered to pay a £15 victim surcharge – a total of £90.

“Fly Posting is illegal and is a common problem throughout the area of Rhondda Cynon Taf. This can have a detrimental impact on the environment as the posters/banners created are often unsightly and placed on boarded up properties.” said Nigel Wheeler, Service Director for Streetcare at Rhondda Cynon Taf Council.

"As well as creating unsightly environmental conditions, the clean up costs of taking them down and cleaning the residue they leave behind a financial burden on the local authority and the taxpayer.

“The Streetcare Enforcement Team will do all in its power to eradicate this type of behaviour in the Country Borough in an effort to make Rhondda Cynon Taf a clean and safe place to visit, work and live in.”

Since April 2009 more than 844 fixed penalty notices have been issued to individuals who committed acts of environmental crime, which includes, fly posting, dog fouling, fly tipping, littering and cigarette butts. This has resulted in environmental criminals coughing up a whopping £69,300, which could be avoided by using the waste facilities available.

Of these the greater majority were issued for those individuals who discarded rubbish from their vehicles – ranging from cigarette butts to banana skins. Refusal to pay the £75 notices led to some of these being dealt with at Magistrates Court and often resulting in several hundred pounds worth of fines and costs being imposed on them when found guilty.

The message is clear – eco-criminals in Rhondda Cynon Taf will not be tolerated and there is no escape thanks to this new initiative.

Anyone found committing an eco-crime in the County Borough could face at least £75 fine or worse if they fail to pay the fixed penalty notice, including a criminal record.

Surely it's only the small business owner getting no help from a government relying on him pulling in enough business to get the economy growing who is the victim here!

If anything though, the council has succeeded in helping me to decide who to go to for valeting.

There are no bigger eco-criminals in RCT than RCT Council themselves, who vandalise our green and pleasant land with impunity by giving their developer pals the green light to wreck whatever green areas they choose to turn into profit.

Once again, the real criminals are shown to be the ones who make the rules for the rest of us. No wonder there's so much cynicism around, especially when I hear these incompetents spouting their meaningless drivel about caring for the environment and looking after local green areas where kids can play and people can walk. Not when the developers have got their covetous eyes upon them they don't.

There is obviously a need to prevent rouges signs and commercial fly posting, but is fines and council snoops the best way to stop it? The last Plaid administration of RCT decided to license council owned land for such purposes on payment of a small fee in advance. Instead of the cash going to the coffers of HM Treasury in London in the form of a fine, it went into a local enterprise account in RCT to be spent on promoting local businesses. If I remember correctly, there was a roundabout on the Aberdare bypass which was allocated for such purposes.

Advertisement on roundabouts is like using a mobile phone whilst driving , bloody stupid. You should foucs on the road and not go window shopping.

You should see it in france its mad, with all the hotel and restaurant signs on the side of the road.

I see the Labour controlled

I see the Labour controlled council jobs worth has been at it again this time picking on someone who is trying to start a business opening up the New Inn in Ystradfellte that has been closed for 2 years.

Attempting to advertise on the A4059 he had 8 signs vandalised at a cost of £45 each, he tried another type of advertising and got fined by the dedicated streetcare enforcement team at Rhondda Cynon Taf Council to the sum of £150.

He has requested help from the tourist department at RCTC but as we know they are too lazy to do anything to help the tourist industry in RCT.

This dedicated streetcare enforcement team must be cherry picking victims because there is enough fly posters around Aberaman to subsidise the rates but local councillors turns a blind eye to that.

I'm sure too that RCT issue

I'm sure too that RCT issue warnings first to take down the signs - I recall a guy in Mountain Ash that was fined after he was told to take down signs on the main road about his car wash place about a year ago. When it was in the press it said he had been warned twice before being issued a £75 fine - he refused to pay it and ended up with a court fine of about £200 so it wasnt straight forward as the guy tried to make out.....

Is it time for site owners

Is it time for site owners of trading estates to erect professional commercial direction signs showing the public what and where establishments can be found?

You don’t see rouges signs to the extent on Treforest Estate and others with in RCTC area as you see in Cynon Valley.

Perhaps it’s too costly for RCTC to act against rouges signs or is there some other reason?

If anyone has a road accident and there are a number of illegal signs around can your insurance claim off the local authority for not taking action are signs a distraction?

With the exception of temporary local directional non-advertising signs, all unauthorised signing (including posters, placards, banners and advertising boards), erected anywhere within the boundary of county highways, that seeks to advertise businesses, services, goods or commercial events will be prohibited on a countywide basis. The enforcement of this policy will be applied consistently across the county.

The Legal Position
Unauthorised signs within the highway are illegal. A good guide to what this means is signs other than road signs or signs erected by the Highway Authority (the County Council) or with their permission. All other signs are illegal, and because they can obstruct the highway, impair visibility, result directly in damage or injury, or form a dangerous distraction, the Highway Authority has a duty to seek their removal or to remove them itself.

2.3 Highways Act 1980
Section 132(2) of the Highways Act 1980 makes provision for the highway authority to remove any picture, letter, sign or other mark painted, ascribed or affixed on the surface of the highway, or any structure or works on or in the highway. This provision encompasses fly-posting on street furniture and gives authority to remove posters without notice.

The local planning authority may not under subsection (1) remove a display structure unless the local planning authority have first served a removal notice on a person who appears to the local planning authority to be responsible for the erection or maintenance of the display structure.

rct says it is for the community to have green land and safe street what about aberdare on friday saturday and sunday, with drugs, violence, vomit, litter, why dont they do something about that the reason is they are afraid,why not have these good pepole who pick on the little people to sort out aberdare on the weekend answer from them is it's the police who do that phone them, or social services, or batman and robin but don't bother us we finished work when we had our last money for our meeting,the next time we will be bothered is when we collect our next money so until then

Before fining people for fly posting it might be a good idea to make it a bye law that every business wherever they are situated must display their correct address.

It can be very frustrating if you are looking for a certain business when they don't display their street number when they are situated within the confines of other businesses, factories, offices etc.

Welsh Conservatives today urged the Welsh Labour Government to consider empowering local authorities to remove unnecessary road signs.

The Conservative-led Government is introducing new powers for local authorities from next year to give greater discretion to remove superfluous road signs.

A number of road signs have come under scrutiny for being duplicated, illegible or simply irrelevant.

Byron Davies AM, Shadow Minister for Transport, said, “Unnecessary road signs not only clutter our natural environment but can also distract drivers, threatening public safety.

“Drivers are constantly being bombarded with information through signs, many of which are unnecessary and detract attention from the important messages.

“Many of the main routes into our towns and cities look messy and chaotic and give an unflattering first impression to tourists and other visitors.

“Welsh Conservatives believe in local accountability and want to see local authorities gain greater flexibility to remove unnecessary road signs.

“The Welsh Labour Government should follow the lead of the Conservative-led Coalition and ease road sign restrictions to make our roads safer and cleaner.”
